NOTICE OF DELEGATED DECISIONS Under RCW 80.01.030, the commission may delegate certain decisions to the Secretary. The commission has adopted rules (WAC 480-07-903, -904 and -905) that identify matters that are delegated. It has also adopted an Internet publication process allowing affected persons to seek commission review of delegated orders. The commission amended these rules, effective September 22, 2008, to require transportation companies whose permit authority is suspended or canceled by delegated order to seek review by requesting a hearing. What this means is: · The commission has created an online “Delegated Orders List” which provides a list of orders that have been delegated. The list can be found by going to the commission’s Web site, clicking on "Documents," and then looking under “How to find documents.” · Affected persons have a right to request review of those decisions within 14 days after posting. · A form is provided on the Web site to request review: The form includes an option for requesting a hearing for review of orders suspending or canceling a transportation carrier permit. · The form may be submitted for processing directly to the Records Center via e-mail at records@utc.wa.gov or through the commission’s Web site using the Records Center Web Portal. · Open Meeting Review: Once a person seeks review of a delegated order relating to utility companies, the item will be taken up at the next available Open Meeting. · After discussion at the Open Meeting, the commission will act upon the filing and an order will be entered to implement the commission’s decision. · Hearing Review: Once a person seeks review of a delegated order suspending or canceling the permit of a transportation carrier, the commission will issue a notice of hearing, setting the matter for review in an adjudication under RCW 34.05, Part IV, or a brief adjudicative proceeding under RCW 34.05.482 through .494, before an administrative law judge. · After hearing, the administrative law judge will enter an initial order, which is subject to administrative review under RCW 34.05.464, or .491.
